For purposes of determining venue, is the federal criminal offense of willful failure to "immediately notify" the Coast Guard of a "hazardous condition" aboard a vessel a continuing offense? The majority on a divided three-judge panel of the U.S. Court of Appeals for the Sixth Circuit answers yes in a ruling issued today.

Chief Judge Alice M. Batchelder disagreed with that result and set forth her views in a rather persuasive dissent.
