Quite a day for meaty appellate issues: Jonathan Stempel of Reuters has an article headlined “Lawsuit over Hebrew National hot dogs is revived” that begins, “A year after ConAgra Foods Inc won the dismissal of a lawsuit claiming that its Hebrew National hot dogs were not kosher, a higher authority has given the case new life.” You can access today’s ruling of the U.S. Court of Appeals for the Eighth Circuit at this link.

And Andrew Zajac of Bloomberg News reports that “Meat Labeling Case to Be Reheard by Full U.S. Appeals Court.” You can access today’s order of the U.S. Court of Appeals for the D.C. Circuit granting rehearing en banc at this link. One week ago today, a unanimous three-judge D.C. Circuit panel issued a decision in the case containing a footnote recommending en banc review.
