“Finally, we conclude that the district court abused its discretion in making Lundquist jointly and severally liable for all of Amy’s losses.” The U.S. Court of Appeals for the Second Circuit today issued a ruling addressing the question of criminal restitution in a child pornography case involving the same images as were involved in the other In re Amy Unknown cases.

The U.S. Supreme Court has already agreed to resolve this issue, which was already the subject of a circuit split, in a case scheduled for oral argument during the October 2013 Term.
