“Court wants to uphold historic Pensacola cross, but can’t — yet; Majority says cross should be constitutional, city says it will appeal”: The Becket Fund for Religious Liberty issued this news release today about a per curiam ruling that the U.S. Court of Appeals for the Eleventh Circuit issued today.

Circuit Judge Kevin C. Newsom issued an opinion concurring in the judgment calling for en banc review.

And Senior District Judge C. Ashley Royal (M.D. Ga.), sitting by designation, also issued a lengthy opinion concurring in the judgment calling for en banc review.
