Ninth Circuit denies rehearing en banc in Proposition 8 lawsuit: You can access today’s order of the U.S. Court of Appeals for the Ninth Circuit at this link. Only four judges noted their dissent from the court’s denial of rehearing en banc. And the two judges who constituted the majority in the original three judge panel’s ruling wrote a one-paragraph response to the three-paragraph dissent from the denial of rehearing en banc.
