“This appeal presents the question whether the federal judiciary should create a right of action for damages against soldiers (and others in the chain of command) who abusively interrogate or mistreat military prisoners”: So begins the opinion that Chief Judge Frank H. Easterbrook wrote on behalf of a majority of the en banc U.S. Court of Appeals for the Seventh Circuit in a decision issued today.

Today’s en banc ruling holds that a common-law right of action for damages should not be created. Back in August 2011, the majority on a divided three-judge Seventh Circuit panel issued a ruling that allowed part of this lawsuit to proceed. My earlier coverage of that ruling can be accessed here.
