In coverage of the case that I orally argued before a different three-judge Third Circuit panel on Tuesday, Matt Fair of Law360.com reports that “3rd Circ. After presenting my oral argument on Tuesday, I took the elevator down three floors to observe some of the arguments that a third Third Circuit panel was conducting in Courtroom 16-A. The case being argued at the time was Patricia Young v. Pleasant Valley School District, which had been the subject of much news coverage while pending in the trial court. In August 2013, The Morning Call of Allentown, Pennsylvania published an article headlined “Pleasant Valley cleared in teacher sex-talk case; Federal jury rules district did not retaliate against student who complained about teacher’s methods.” Earlier, in May 2012, The Pocono Record reported that “New trial granted to former teacher Bruce Smith, Pleasant Valley School District.” You can access the new trial ruling at this link.
