Just your typical Sunday night Fifth Circuit decision quashing a subpoena against the Texas Conference of Catholic Bishops in Whole Woman’s Health v. Smith: You can access this evening’s ruling of a divided three-judge panel of the U.S. Court of Appeals for the Fifth Circuit, in which each of the three judges on the panel wrote separately, at this link.

At issue in this particular discovery dispute is a Texas requirement governing the disposal of fetal remains. Circuit Judge James C. Ho issued another provocative concurring opinion.
