Programming note: On Tuesday morning, I will be arguing an appeal before a three-judge panel of the Superior Court of Pennsylvania.
The most newsworthy case scheduled for oral argument tomorrow before that same three-judge panel will be this case, which has been specially scheduled for argument starting at 3:30 p.m. and is expected to draw a large crowd of onlookers and media.

Access today’s ruling of the U.S. Court of Appeals for the Fifth Circuit in United States v. Butt: At this link. Not only did the Court refrain from referring to either of the two Butt parties by their last name, but the Court also avoided any Butt-related humor — made easier no doubt by the fact that Circuit Judge Don R. Willett wasn’t even on the three-judge panel that decided this case.
