Some data on when documents are being filed in the federal appellate courts: A vibrant discussion among experienced Third Circuit practitioners (who thus far appear to be almost uniformly opposed) occurring via email about yesterday’s proposed rule change that would impose a 5 p.m. electronic filing deadline instead of the current 11:59:59 p.m. deadline has resulted in the sharing of two studies from the Federal Judicial Center (access here and here) on when documents are being filed in the federal appellate courts.
