“Deputies Escape Liability for Detaining Wrong Man for Three Days”: Bernie Pazanowski of Bloomberg Law has this report (subscription required for full access) on an en banc ruling that the U.S. Court of Appeals for the Eleventh Circuit issued today.

Circuit Judge Kevin C. Newson issued a concurring opinion “to reiterate (once again) my grave reservations about the role that ‘substantive due process’ has come to play in constitutional decisionmaking.”

And Circuit Judge Robin S. Rosenbaum issued a solo dissenting opinion asserting that the majority’s “misguided view of the Constitution is horrifying.”
